Taking a baby or a young child around New York raises one question fast: do they need a car seat in a taxi or an Uber? The law gives taxis a pass. A crash puts your child at the same risk in any car.
This guide covers NYC car seat law in 2026, how Uber Car Seat works, what to do in a yellow cab, which seat fits which age, and how to fly in with a car seat. We’re a New York car service that installs car seats every day, so we’ve seen what works at the curb.
Quick answer: New York’s car seat law covers children under 8, but it exempts taxis and liveries. A yellow cab won’t have a seat, so you bring your own. Uber Car Seat gives you one convertible seat by reservation. A booked car service can install the seat before pickup.
NYC car seat law: do you need a car seat in a taxi or Uber?
Under New York Vehicle and Traffic Law section 1229-c, children under 4 must ride in a federally approved car seat. Children 4 to 7 ride in a car seat or booster, unless they’re taller than 4 feet 9 inches or heavier than 100 pounds. Kids under 2 stay rear-facing until they outgrow the seat’s rear-facing limits. From 8 to 16, every child wears a seat belt.
| Age | What New York law requires |
|---|---|
| Under 2 | Rear-facing car seat until the child outgrows its rear-facing limits |
| Under 4 | Federally approved child car seat |
| 4 to 7 | Car seat or booster, unless over 4 ft 9 in or 100 lb |
| 8 to 16 | Seat belt |
The same law says those car seat rules “shall not apply to taxis and liveries.” Seat belts still apply to kids 8 to 16. So a yellow cab can legally carry a 2-year-old on your lap.
The exemption only covers the driver’s legal duty. A crash at 30 miles an hour in a cab is as dangerous for a child as a crash in any car. The NYC Taxi and Limousine Commission still tells parents that children under 4 must ride in child safety seats.
What about Uber and Lyft? No court or agency has settled whether app rides count as “liveries” under the exemption. Don’t count on it. Uber drivers can also refuse a trip if your child doesn’t have the right seat.
Could the law change? Two bills in Albany, S9800 and A1540, would end the taxi and livery exemption and require seats for children under 8, with a fine of up to $50. As of October 2026 both sit in the Transportation Committee. Neither is law.
Your options: yellow taxi, Uber Car Seat or a booked car

The three ways to ride with a child in New York, side by side.
| Yellow taxi | Uber Car Seat | Booked car service | |
|---|---|---|---|
| Seat supplied | No, bring your own | Yes, one convertible seat | Yes, installed before pickup |
| Seats per car | Whatever you bring | 1 | Up to 2 at Gotham Ride |
| Child size | Any, with your seat | 5 to 65 lb | Infant to booster age |
| Booster seat | Bring your own | Not offered | Yes |
| How to book | Hail on the street | Reserve in the app | Book online or call |
| Seat cost | Your own seat | $10 surcharge | Free at Gotham Ride |
Uber Car Seat is a good fit for one child between 5 and 65 pounds on a short ride you can plan ahead. It won’t cover a newborn under 5 pounds, a booster-age child, or two kids. A yellow cab works if you carry your own seat and can install it fast at the curb.
A booked car fits airport trips, two children, or a family with a stroller and bags. At Gotham Ride, our car service with car seats includes the first two seats free, installed before the car arrives.
Which car seat does my child need?
Pick the seat by your child’s age, weight and height, then check the limits printed on the seat’s label. The ranges below are typical for each seat type, based on the AAP’s 2026 car seat listing.
| Seat | Who it fits | Typical limits |
|---|---|---|
| Rear-facing infant seat | Newborns and babies | About 4 to 30 lb, up to about 32 in |
| Convertible seat | Babies and toddlers | Rear-facing about 5 to 40 lb, forward-facing with harness about 22 to 65 lb |
| High-back booster | Kids about 4 to 8 | About 40 to 100 lb, about 43 to 57 in |
| Seat belt | Kids who pass the belt-fit test | Usually about 4 ft 9 in |
The AAP advises keeping children rear-facing as long as the seat allows, then using a harness, then a booster until the adult belt fits. The belt fits when the lap belt sits low on the hips and the shoulder belt crosses the middle of the chest. For most kids that’s around 4 feet 9 inches.

Can you hold a baby on your lap in a taxi?
In a New York taxi, yes, it’s legal. It isn’t safe. In a sudden stop, a child’s weight multiplies, and no parent can hold on. The adult’s own body can also crush a child on a lap against the seat in front.
A soft baby carrier doesn’t count as a restraint either. If you’re taking a cab with a baby, bring an infant seat that can install with the car’s own belt. Most infant seats can, without the base.
Flying into New York with a car seat

Children under 2 can fly on your lap without their own ticket. If you buy a seat for your baby, you can use your car seat on the plane when its label says it’s “certified for use in motor vehicles and aircraft.”
Most airlines don’t count a car seat or stroller as luggage, so you can check it or gate-check it for free. Rules change, so confirm with your airline before you fly.
Carrying a seat through JFK, LaGuardia or Newark with a toddler and bags is hard work. Two easier options:
- Book a car with the seat installed. Your chauffeur meets you after baggage claim with the right seat already in the car.
- Bring your own and let the driver help. If your child sleeps best in their own seat, a car service chauffeur can help you install it.

Bringing your own seat into a taxi or car
The TLC says passengers “are allowed to bring and use their own car seats and booster seats for children” in any TLC-licensed vehicle. A driver can’t stop you from installing one.
A few tips for the curb:
- Practice a seat-belt install at home. Lower anchors in a cab can be hard to reach.
- Keep the door open until everyone has buckled up.
- A lightweight convertible seat or a travel booster is easier to carry around the city.
- Booster-age kids can use a compact backless booster, as long as the car has a lap and shoulder belt.
Airport tips for parents
At JFK, LaGuardia and Newark, the taxi line is the slowest part of arriving with kids. If you book a car, give the company your flight number so the driver tracks the landing time. At Gotham Ride, airport arrivals include 60 minutes of complimentary wait time on domestic and international flights alike.
Leave extra room for bags. A stroller, two car seats and suitcases won’t fit a sedan. An SUV or a van will. For routes and drive times, see our JFK airport car service, LaGuardia car service and Newark Airport car service pages.
Car seat questions from parents
Do kids need a car seat in an NYC taxi?
New York law exempts taxis and liveries from its car seat rules, so a cab can legally carry a child without one. It isn’t safe. You can bring and install your own seat in any yellow cab.
Can you get an Uber with a car seat in NYC?
Yes. Uber Car Seat in New York gives you one convertible seat for a child from 5 to 65 pounds. You reserve it ahead in the app, and Uber adds a $10 surcharge. It doesn’t offer boosters or a second seat.
Can my 7-year-old ride in an Uber without a car seat?
New York law requires a car seat or booster for children under 8 unless they’re over 4 feet 9 inches or 100 pounds. Nobody has settled whether app rides fall under the taxi and livery exemption, and Uber drivers can refuse a trip without the right seat. Bring a booster to be safe.
Can I take my baby in a taxi in New York?
Yes. Bring an infant seat that installs with the car’s seat belt, and buckle it in before the cab moves. Holding a baby on your lap is legal in a taxi, but it isn’t safe.
Is there a car service for kids riding alone?
Uber requires riders under 18 to travel with an adult. Gotham Ride carries kids 13 and older on their own, with a live tracking link for the parent and an ID check at drop-off.
Do airlines charge to check a car seat?
Most airlines check a car seat or stroller for free, at the counter or at the gate. Check the baggage rules with your airline before the trip.
Need a car with the seat already in it?
Gotham Ride installs rear-facing infant seats, convertible seats and boosters before pickup. The first two seats are free.
